INFORMATION COLLECTED ABOUT YOU
There are several areas on our Sites where we request information from you. We ask for this information so that we can enhance your visit to our Sites, to fulfill your requests, facilitate the Practitioners’ provision of the Services to you, ensure proper functioning of our Sites and technology, or to follow up with you after your visit. Your personal information is used only for the purposes for which you provide it. We take reasonable steps to ensure that information that we receive from you is reliable for its intended use, accurate, complete and current, including providing mechanisms by which you can amend or update your information.
INFORMATION COLLECTED BY VTC
Upon registering to use the Sites, you will create a User ID and password (“Logon Credentials”). Each time you access the secure sections of the Sites you will be asked to enter your Logon Credentials. During the registration process you may be asked to enter personal information, including name, date of birth, address, phone number, email address, and certain basic health-related information (“VTC Information”). The information on the registration form will be securely shared with your Practitioner and retained securely by us for our records. The VTC Information will only be used in connection with providing the Services.
USE OF SITE AND SERVICES BY MINORS
Anyone that is under the age thirteen (13) years old (“Minor Child”) may not create a Site User account. Only a parent/guardian may create a Site User account for a Minor Child, and a Minor Child may only access the Sites and receive Services if the Practitioner or Organization at the time of registration complies with the requirements of the Children’s Online Privacy Protection Act (“COPPA”). Such requirements include, without limitation, parental or guardian consent. All Practitioners and Organizations on our Sites represent and warrant that they will comply with such requirements before providing access to a Minor Child. During the registration process, the parent or guardian must create the Logon Credentials for their Minor Child, and the Minor Child account must be tied to a parent or guardian email account. When a Minor Child is using the Sites or Services, the parent or guardian must be the one to enter the Logon Credentials for their Minor Child, and the parent or guardian is the only one that can provide any e-signatures or regular signatures for documents required by the Practitioner or Organization. If you do not receive any correspondence regarding COPAA from your Practitioner or Organization after registering your Minor Child as a Site User, please contact VTC. VTC WILL IMMEDIATELY INVESTIGATE ANY PRACTITIONER VIOLATION OF THE COPPA COMPLIANCE PROVISION AND NON-COMPLIANCE WILL RESULT IN IMMEDIATE TERMINATION OF A PRACTITIONER’S OR ORGANIZATION’S ACCESS TO THE SERVICES AND THE SITES.
INFORMATION COLLECTED BY PRACTITIONERS USING VIRTUAL THERAPY CONNECT
When you use the Sites, our servers automatically record information that your browser sends. This may include information such as your web request, Internet Protocol address, browser type, the date and time of your request and one or more cookies that may uniquely identify your browser. We use this information to analyze Sites’ usage, to access which ISP providers are sending people to our Sites, to make web design decisions, and to know who is using our Sites.
When you elect to send an email or other communication through the “Contact Us” section of the Sites we may retain those communications (including your name, email address, and any other information you provide) in order respond to an inquiry, respond to a request or improve our Services.
USE OF THE VTC INFORMATION
The VTC Information you provide to us will be kept confidential and used only by us and our third-party providers facilitating delivery of the Services. We require that these parties agree to process such information based on our instructions and in compliance with all relevant laws regarding protection and use of your personal information and any other appropriate confidentiality and security measures. It will not be passed to third parties for their marketing purposes. We may also share aggregated customer information such as statistics about our customers, sales, traffic patterns and related Sites information, with our business partners and other reputable vendors, but such aggregated information will not contain any personally identifying information of any users of the Sites. We may disclose or access your account information when we believe in good faith that the law requires it.
PAYMENT FOR THE SERVICES
Unless otherwise agreed by contract, payment for the Services is facilitated by a third party and not VTC. VTC does not receive your payment for the Services. VTC ASSUMES NO RESPONSIBILITY FOR YOUR USE OF ANY PAYMENT PROCESSING SYSTEM PROVIDED BY THE PRACTITIONERS OR ORGANIZATIONS. WHEN YOU SUBMIT YOUR CREDIT CARD INFORMATION FOR PAYMENT OF THE SERVICES, YOU DO SO UNDER THE TERMS AND CONDITIONS THEY SPECIFY. WE DO NOT GUARANTEE THE SECURITY OF YOUR INFORMAITON WHEN PREOCESSED BY THE PRACTIONOERS, ORGANIZATIONS, OR THEIR THIRD-PARTY PROVIDER.
YOUR RIGHT TO CHOOSE
Any information that VTC collects from you on the Sites is information that you specifically and voluntarily provide. You may choose not to provide any or all of the information that is requested on the Sites. By so choosing, however, you may limit your ability to receive some or all of the Services generally offered to users of the Sites. ACCESS TO YOUR INFORMATION
Upon request, we will take reasonable efforts to provide you with access to your information to review it for accuracy and make any modifications that you deem appropriate. Parents may review their children’s information, have it deleted from VTC’s records (as permitted under applicable law) or Practitioner’s records or refuse to allow future collection of their child’s information at any time. Refusal to allow future collection of your child’s information will prevent your child from continuing to receive the Services. THE SECURITY OF YOUR INFORMATION
We strive to protect the privacy of the VTC Information that you share with us. We have undertaken reasonable efforts to implement security measures designed to protect all data we collect against unauthorized access. We utilize the industry standard security measures available through your browser, so that it is unlikely that your information can be read as it travels over the Internet. These measures include encrypting the Services, the VTC Information and other areas of the Sites where we collect personal information from you with either 128-bit SSL or 256-bit SSL, conducting internal reviews of our data collection, storage and processing practices and security measures, as well as using physical security measures to guard against unauthorized access to our systems. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, although we strive to protect your information, we cannot ensure or warrant the security of the VTC Information that you submit to us via the Sites and you do so at your own risk. We comply with relevant laws regarding protection of personal, health, and financial information to the extent such laws apply to us.
TRANSFER OF BUSINESS ASSETS
As part of our business strategy, VTC or substantially all of its assets may be acquired, in such case, Logon Credentials and VTC Information will be part of the transferred assets.
